Often people will say to me, "can the police just stop me when I am walking down the street" it is a funny question. How many times in someones life will the police ask them to stop while walking down the street. Well in some places a lot, and in other places never. However in this instance below lets assume this has to do with a Nashville public intoxication stop scenario.

If a reasonable person would not feel free to leave, then it is a Seizure under the 4th Amendment, and all evidence gained could be suppressed for a 4th Amendment violation by the government.
As with all legal discussions of the 4th Amendment there is an exception to the above noted scenario, if the police believe that they have an inarticulable suspicion that crime is afoot and they suspect you are involved somehow they may perform what is known as a Terry Stop. This is a situation where they suspect you for something, say suspicious activity around a store that was broken into the night before. They can stop you, ask questions and pat you down for weapons, however this brief detention even with cause can turn into an arrest if they detain you to long, and later it is determined there was no reason to continue to detain you after their original suspicions were proven unfounded. Terry Stop cases are voluminous, this is just a small snippet of a Terry Stop.

I am often asked by young men, especially high school age young men, what is the definition of rape in Tennessee. We all understand the horrific nature of the crime, however what some people do not realize is that many rapes in Tennessee are not by strangers. Many allegations of rape hinge on quite literally he said she said, and the parties know each other.
So in Tennessee what is rape? It is the unlawful sexual penetration of a victim by the defendant or of the defendant by a victim accompanied by any of the following circumstances:
Force or coercion is used to accomplish the act;
The sexual penetration is accomplished without the consent of the victim and the defendant knows or has reason to know at the time of the penetration that the victim did not consent;
The defendant knows or has reason to know that the victim is mentally defective, mentally incapacitated, or physically helpless;
Sexual penetration is accomplished by fraud.
That is the legal definition. The question posed to me quite often is what if someone is drunk? The answer lies in the details of was the person mentally incapacitated at the time of the penetration, (penetration does not have to be with a body organ, it can be with an object).
Lets say a young couple of high school age has been drinking together, they start drinking around 8 pm, each of the individuals has about 5 beers over the course of the night. They are parked at the end of a road. The couple has never engaged in a sexual act before this night, the young man thinks it is ok to kiss on the young woman, but then thinks it is ok to proceed further by engaging in a sexual act with the young lady, while she is intoxicated. If later the next day the young lady states that she did not consent to the sexual act there can be a charge of rape filed in Tennessee. It is a matter of perspective as to whether or not she consented to the sexual act. It is here we find the he said she said problem. This situation is often referred to as Date Rape by the media.
My advice to young people is to simply avoid this situation, if you do not know whether or not she is consenting then avoid the situation all together.

Trump Gives Former Miss PA Sheena Monnin a Second Chance

Donald Trump: All is forgiven if Miss Pennsylvania apologizes for rigging accusation within 24 hours.
The question remains, will Shenna give herself a chance?
I don't think Sheena Monnin will apologize unless she takes to heart John 3:13 which she exhibits on her Facebook profile as her religious belief... which says among other things....
....God did not send his one and only son into the world to condemn the world....
Its not her accusation that the Miss USA pageant rigged the contest that's is troubling Miss Monnin, nor is it a fear of the Trump legal team. Miss Monnin needs to answer to God for her judgemental bigotry. Miss Morrin needs the gift of peace and that would take a gift of love from the lord. That's a really big deal and may not fit within the 24 hours allotted by the the Trumpster.

"I refuse to be part of a pageant system that has so far and so completely removed itself from its foundational principles as to allow and support natural born males to compete in it. This goes against ever moral fiber of my being. I believe in integrity, high moral character, and fair play, none of which are part of this system any longer.
"I hereby return the title of Miss Pennsylvania USA 2012."
I hope Sheena Monnin allows herself a chance and comes clean about the real reason for her abdicating her title. Its a make or break decision for her that would allow her the opportunity to get to know love.

We have made some notable progress so far this year with the exception of Cece McDonald's imprisonment, and the overwhelming percentage of murdered sisters who are trans woman of color. Our Agenda is non exclusionary and simple. All we ask for is full equality and integration into politics, religions and society. We seek nothing more, nothing less as we live our lives loud and proud.
Equality wins. Hate loses. Lately there have been people who's agendas are diametrically opposed to ours and consequently have been at the losing end of the struggle. They all have ia few things in common. They are playing the victim card and making outrageous allegations and associations.
Some Miss Universe Canada supporters said transgender contestant had a 'unfair advantage'. Personally, I thought her unfair advantage was the sun which never set on her, but then that's just my opinion.
And recently Miss Pennsylvania who quit her title saying the contest was rigged but in fact it was her abhorrence of transgender people that made her abdicate her title.
Then there's the outcast "RadFems" who claim they are advocating for all of womankind. Make that 'woman born woman" excluding all who they consider not "Naturally Born Woman".. Sound familiar? It should because that is the cornerstone of transphobes world wide. The phraseology differs as does the venues it is delivered but it is all transphobia just the same.
No it's not a lynch mob that's facing up to transphobia, its a few lone voices, bloggers and activists in the wilderness who are being heard, respected and amplified by the rest of the world.
What may seem to be a transgender lynch mob to RadFems is in reality, just everyone else in the world. I would strongly suggest RadFems consider the analogies they present before they make them public.

Why is Jillian Page Afraid to Say Nigger? Because its Stuff Black People Hate and she knows its been judged inappropriate by the majority of the black population especially if it's usage is used in a apology to non blacks for saying it!
Its simple and Page knows it. That word is defamation and was naturally eliminated from everyday conversation as black people's struggle for rights progressed. They enabled themselves by setting that social construct.
Then why is Page unafraid to say tranny? Because conversely she believes that this like defamation is just fine for everyone to use, even cisgender people! She qualified that argument by saying she googled tranny and found that the majority of links were about transgender people.
What the fuck Page? You forgot to mention the first link was the Wikipedia definition of Tranny

Now I'll be objective...
A while back I did a survey albeit a brief one, called Who we Are. I did so because as advocate who was ardently opposed to the horrific movie "Ticked Off Trannys With Knives" I needed to know I was speaking for the majority of our community.

The survey clearly indicates the vast majority of our people object, as black people do, to defamatory words like "Tranny" being used outside of the respective community.
And Page, you didn't mention nearly everyone of the rest of the "Transgender" links were for pornography sites that prey on the most vulnerable of our society. Some not all, of these transgender people are allowing themselves to be used so to feed addictions. Paige also failed to mention that drugs play a major role in the majority of murders of our people. Black transgender woman of color murders.
Damn.
Page, one more thing. You remember the celebrities who used to to say "Nigger" in comedy acts? Most of them are dead now and like our slain trans sisters drugs nearly always played a role in there early demise.
Paige you can make fun of the transgender community for our empowering edit of the word...but....

.....I find it extremely disturbing that while you show respect for another minority you have no problem dehumanizing and demoralizing your own. Proof positive transphobia can emanate from anywhere, even from within the transgender community.

You will have a few standing on your side of the fence Paige, manly populists and gay men enthusiastic about another stab at us, but you are alone and very, very wrong.

Then why is Page unafraid to say tranny? Because conversely she believes that this like defamation is just fine for everyone to use, even cisgender people! She qualified that argument by saying she googled tranny and found that the majority of links were about transgender people.

Now I'll be objective...
A while back I did a survey albeit a brief one, called Who we Are. I did so because as advocate who was ardently opposed to the horrific movie "Ticked Off Trannys With Knives" I needed to know I was speaking for the majority of our community.
The survey clearly indicates the vast majority of our people object, as black people do, to defamatory words like "Tranny" being used outside of the respective community.
And Page, you didn't mention nearly everyone of the rest of the "Transgender" links were for pornography sites that prey on the most vulnerable of our society. Some not all, of these transgender people are allowing themselves to be used so to feed addictions. Paige also failed to mention that drugs play a major role in the majority of murders of our people. Black transgender woman of color murders.
Damn.
Page, one more thing. You remember the celebrities who used to to say "Nigger" in comedy acts? Most of them are dead now and like our slain trans sisters drugs nearly always played a role in there early demise.
Paige you can make fun of the transgender community for our empowering edit of the word...but....
.....I find it extremely disturbing that while you show respect for another minority you have no problem dehumanizing and demoralizing your own. Proof positive transphobia can emanate from anywhere, even from within the transgender community.
Page, its not just a few transgender activists who rightly object to the promotion of tranny, quite the opposite. Its by far the majority of our community.
You will have a few standing on your side of the fence Paige, manly populists and gay men enthusiastic about another stab at us, but you are alone and very, very wrong.

A Social Justice and Art project of Gabrielle Le Roux, about Trans Activists in Turkey with the support of Amnesty International Turkey and the Consulate General of Netherlands.
The first ever Trans Pride March in Turkey was in 2010 in Istanbul. This short film documents the second Trans Pride and shows the passion and colour that the mobilization of Turkey's trans movement brought into the street. After this march, for the first time ever, the reporting on trans issues improved.
There is a frighteningly high, and growing, incidence of hate crimes and murders of transgender people, specially trans women, in Turkey, and a vibrant, motivated, politicized trans movement has emerged in response and is demanding to be heard.
These films comprise the video installation in the exhibition Proudly Trans in Turkey. The travelling exhibition, a cultural intervention for social justice, combines portraits drawn from life, first-person stories, interviews and video. It is a call to solidarity with the trans rights movement in Turkey. It is a co-creation between Turkish activists and South African artist and activist for social justice Gabrielle Le Roux.

Let's Go Fly a Kite, or A Boat Load of Pictures

Uncle Chuck and Aunt Lara came to celebrate REH's 7th birthday (and maybe they came to celebrate my birthday too?). We spent all day outside playing. They brought a whiffle ball set and a kite and the kids had a BLAST! TJH especially enjoyed the kite; REH and SEH especially enjoyed the ball and bat. Proof is in the enormous amount of pictures. (Remember you can click on them to enlarge and accept my apologies for the amount: I couldn't decide what to keep and what to reject).











And then Auntie and Uncle were absolutely wiped out from playing all day. So were the kids, though. I put them down for a "nap" at 6PM and they woke up at 8 for dinner and most of them went right back to bed.
The Monday after (uh, yesterday...), TJH wanted to do nothing but go fly the kite again:

















And then it all ended when it landed in the tree. :) No worries, though, I went out and got two more. At $2 each, they are well worth it.
